Acting on behalf of a Tier 1 M&E construction claimant. His appointment was to independently analyse a time-related claim under a European standard form of construction Contract.
Background
The defendant’s material procurement was delayed due to the late employer design, multiple design changes, and an ‘evolving design’. The design delays impacted the project’s critical path, contractual milestones and ‘Power On’ date.
Evaluation
Matthew assessed contemporaneous project records and established a claims narrative and detailed windows analysis. This approach demonstrated the claimant’s entitlement to an Extension of Time and associated prolongation costs under the contract.
